• 1.1 This Agreement, together with our privacy policy, governs your use of the New Media Production Guide (the "Service"), including the nmpg.org interactive chat and discussion areas (the "Interactive Areas"), which are operated by Stephen A. White & Gigasight Media Inc..


• 1.2 Stephen A. White & Gigasight Media Inc. reserve the right, in their discretion, to change or modify all or any part of this Agreement at any time, effective immediately upon notice published on the Service. Your continued use of the Service constitutes your binding acceptance of these terms and conditions, including any changes or modifications made by Stephen A. White & Gigasight Media Inc. as permitted above. If at any time the terms and conditions of this Agreement are no longer acceptable to you, you should immediately cease use of the Service and the Interactive Areas.


• 1.3 Use of the New Media Production Guide signifies that you accept the concept of an unrestricted exchange of ideas, opinions, suggestions, etc. by peers; and that you will not take any legal action of any kind against the NMPG or any NMPG member for expressing their opinions on the NMPG.
  
• 1.4 Also, keep in mind that the NMPG, Stephen White and Gigasight Media Inc. do not necessarily endorse the ideas, opinions, suggestions, etc. made by members of the NMPG.


• 1.5 Joining the New Media Production Guide also signifies that you agree to treat other members with the same courtesy and respect that they will give you. While we recognise not everyone will agree with the ideas, opinions, suggestions, etc. expressed on the NMPG, unprofessional behaviour such as personal attacks, threats, unfounded criticism, etc. will not be tolerated.

2. Use of Content.

• 2.1 You acknowledge that the Service contains information, software, photographs, audio and video clips, graphics, links and other material (collectively, the "Content") that are protected by copyright, trademark or other proprietary rights of Stephen A. White, Gigasight Media Inc. or third parties. All Content on the Service is copyrighted as a collective work of Stephen A. White pursuant to applicable copyright law. You agree to comply with any additional copyright notices, information, or restrictions contained in any Content available on or accessed through the Service. • 5.1 Stephen A. YOU EXPRESSLY AGREE THAT THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SERVICE AND THE ACCURACY OR COMPLETENESS OF THE CONTENT IS ASSUMED SOLELY BY YOU.

WHITE, NOR GIGASIGHT MEDIA INC., NOR ANY THIRD PARTY CONTENT PROVIDER NOR THEIR AGENTS SHALL BE LIABLE FOR ANY ACT, DIRECT OR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICE, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Miscellaneous.

• 9.1 This Agreement shall be construed in accordance with the laws of the State of California and United States of America, and the parties irrevocably consent to bring any action to enforce this Agreement in the courts located in the State of California. Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence. Your use of the Serive and any dispute arising out of such use of the Service is subject to the laws of the State of California and the United States of America. This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof, and supersedes all previous written or oral agreements between the parties with respect to such subject matter. All provisions hereof shall survive any termination of this Agreement as well as any other revisions that by their terms or sense are intended to survive.
